Agreement to Terms
Welcome to Nine Lives Labs. These Terms of Service ("Terms") govern your use of our website, mobile applications, and services (collectively, the "Services") operated by Nine Lives Labs ("we," "us," or "our").
By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Services.

Nine Lives Labs provides mobile applications, games, and software development services. Our Services include but are not limited to:
- Mobile application development and distribution
- Game development and publishing

- Software consulting and contract services
- Technical support and maintenance
User Accounts
Account Creation
To access certain features of our Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials.
Account Responsibilities
You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Acceptable Use
You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

Refunds

Termination
We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

Limitation of Liability
In no event shall Nine Lives Labs, our directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or other intangible losses, resulting from your use of the Services. To the fullest extent permitted by law, our total liability to you for any claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Nine Lives Labs and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
Dispute Resolution

Informal Resolution
Before filing a formal claim, you agree to contact us via our contact page and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days of receipt.
Binding Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration in North Carolina under the rules of the American Arbitration Association (AAA), rather than in court. You waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.
International Users
Our Services are operated from the United States but are accessible worldwide. If you access the Services from outside the United States, you do so at your own risk and are responsible for compliance with your local laws.
European Users (GDPR)
If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR) or equivalent laws, including the right to access, correct, delete, or restrict processing of your personal data, and the right to data portability. California Users (CCPA)
California residents have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to delete personal information, and the right to opt out of the sale of personal information. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting a notice on our Services prior to the effective date of the changes. Governing Law
These Terms shall be interpreted and governed by the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the courts located in North Carolina for the resolution of any disputes.
